ACCEPTANCE

Acceptance of Terms of Use
Any individual using the material of this Site is subject to certain Terms of Use and shall be considered as a "USER", The Terms of Use is a legal agreement between the User and Aspirewiz Technologies. By using this Site, the User acknowledges that the User has read, understood, and agrees to be bound by the Terms of Use. Please review the Terms of Use; should the User does not agree to the terms, the User should not use this Site.

The receipt of an e-mail order confirmation does not constitute the acceptance of an order or a confirmation of an offer to sell. Aspirewiz Technologies reserves the right, without prior notification, to limit the order quantity on any item and/or refuse service to any customer. Verification of information may be required prior to the acceptance of any order.

Terms and Conditions of Sale
THESE TERMS AND CONDITIONS ARE TO BE READ TOGETHER WITH THE APPLICABLE Aspirewiz Technologies, QUOTE OR INVOICE AND Aspirewiz Technologies'S WARRANTY

The following terms and conditions govern the sale by Aspirewiz Technologies ("Aspirewiz Technologies"), a Canadian corporation, to Customer of computer systems and/or related products and services (the "Products") in Canada. By accepting delivery of the Products described on an Aspirewiz Technologies Quote or invoice, Customer agrees to be bound by and accepts these terms and conditions and the applicable terms and conditions in Aspirewiz Technologies's Warranty.
  1. Shipping Charges; Taxes. Separate charges for shipping and handling will be shown on Aspirewiz Technologies's invoice(s). Unless Customer provides Aspirewiz Technologies with a valid and legal tax exemption certificate applicable to the shipping region for the product prior to Aspirewiz Technologies's acceptance of the order, the Customer is responsible for goods and services tax, sales and all other taxes associated with the order, however designated, except taxes on Aspirewiz Technologies's net Aspirewiz Technologies me. If applicable, a separate charge for taxes will be shown on Aspirewiz Technologies's invoice.
  2. Aspirewiz Technologies will take responsibility for loss or damage to Products that occurs during shipment. Title to Products passes from Aspirewiz Technologies to Customer on shipment from Aspirewiz Technologies's manufacturing location. Title to software shall remain with the applicable licensor(s) and all software is subject to the applicable license agreement accompanying the Products. Customer agrees that it shall be bound by each such license agreement once its package is opened or its seal is broken. Shipping dates are estimates and for information purpose only. Aspirewiz Technologies is not liable for delays in shipment or failure to ship by the estimated ship date.
  3. Pricing featured on quotations is valid for a period of 10 days. Prices are subject to change without prior notice. Please verify part numbers, prices, specifications and availability with the dedicated account manager.
  4. Limited Warranty: All Aspirewiz Technologies products shall be free from defects in materials and workmanship at the time of original sale by Aspirewiz Technologies. All Aspirewiz Technologies products are in accordance with our published specifications or those specifications agreed to by Aspirewiz Technologies and the purchaser at the time of original sale.
  5. Warranty Period: Any Warranty Period purchased from Aspirewiz Technologies is from the date of Customer purchase of the product. All defects must be reported to Aspirewiz Technologies during the Warranty Period.
  6. VI. Warranty Rights: For any product found to be defective, and reported to Aspirewiz Technologies to be defective within the Warranty Period, Aspirewiz Technologies, at its option, will repair or replace the defective product. Any repaired or replaced product shall continue for the remaining warranty coverage or shall be covered for ninety (90) days from the date of repair or exchange, whichever is longer. Please note that items purchased from the Factory Outlet are covered with a 30-day warranty only.
  7. Exclusions From Warranty: Any improper installation or use, operation beyond specification, accidents not attributable to Aspirewiz Technologies, substitution of parts not approved by Aspirewiz Technologies or any alteration or repair by others in such manner as in Aspirewiz Technologies's judgment adversely affects the product shall void this Limited Warranty.
  8. Limitation of Remedies: Aspirewiz Technologies's obligation for defective product is limited to repairing or replacing the product, or parts thereof, as expressly stated in this Limited Warranty. In no event shall Aspirewiz Technologies be liable for any direct, indirect, incidental, consequential, or special damages arising out of the operation, or failure of operation, of the product. Aspirewiz Technologies shall not be liable for any costs of procurement of substitute goods, loss of profits, personnel costs, payments to third parties, or any consequential, incidental, and/or other damages of any kind resulting from a breach of any applicable express or implied warranty, or otherwise with respect to the sale of any Aspirewiz Technologies product.
  9. Exclusion of Other Warranties: The above Limited Warranty constitutes the sole and exclusive warranty and remedy with respect to any defective Aspirewiz Technologies product and is in lieu of all other obligations or liabilities of Aspirewiz Technologies. All other warranties, expressed or implied are hereby disclaimed, including but not limited to any warranty of merchantability or fitness for any particular purpose. Aspirewiz Technologies's liability, whether based on contract, warranty, strict liability, tort, or any other basis, shall not exceed the price of the product under claim.
  10. Prior to shipping products back to Aspirewiz Technologies,a Returned Merchandise Authorization (RMA) Number must be obtained from our Service Department. In order to process the return promptly, the products must be returned prepaid to our warehouse with the following: - A copy of the original invoice or packing slip. Serial numbers of products will be verified internally prior to the issue of an RMA. A brief note describing the reason for the return.
    All manuals, accessories and original packaging.
    An Authorization Number on a clearly visible removable sticker on the outside of the box. Box must be clean and free of marks.
  11. XI. Aspirewiz Technologies do not accept shipping on "collect", collect shipments will be refused. Improper packaging, physical damage, or invalid serial numbers will void all warranties. All goods returned for warranty that are found to be non-defective (or damaged as a result of misuse) will be shipped back to the customer collect. A service fee of $50.00 may be applied.
  12. DOA products and/or any shipping discrepancies must be reported to Aspirewiz Technologies within 48 hours of receipt of goods. DOA returns are subject to the RMA return policy outlined in this document.
  13. All defective products that are not reported as DOA within 48 hours will be considered as products that have failed after normal operations and will be dealt with by Service Call through this web site, or by telephone (416-657-4419).
  14. Credit will not be issued on any products purchased over 30 days and on any special order products. Products will be accepted for credit only if returned in resalable condition including original packing and all manuals and accessories. A 20% restocking fee will be applied on returned items. All products returned for credit are subject to the same RAN policy as stated above. Aspirewiz Technologies reserves the right to refuse any request to issue credit for returned product. If authorized by our Service Department, the customer will be issued a credit. XV. 2% per month (24% per annum) interest on overdue accounts will be charged.
  15. Deposits for products on hold or special orders are non-refundable.
  16. Demo computers/notebooks sold, carry no operating system nor any other software unless explicitly identified on the Invoice
  17. In the event that any unidentified software installed on the system purchased, it shall be deemed system sold "as is" and not part of the product purchased. Aspirewiz Technologies holds no responsibility for licensing of the software.
  18. Purchaser authorizes Aspirewiz Technologies to conduct credit checks with various credit agencies.
  19. Products sold as demo, refurbished or used have limited warranty parts/labor for 30 days and no guarantee on battery for on notebooks, unless mentioned otherwise.
  20. All sales are final on Demo/Refurbished/Used products. No returns, exchanges, refunds or credit unless otherwise agreed in writing.
